Welcome to MidTerm Stays (mid-termstays.com). In these Terms, "MidTerm Stays," "we," "us," and "our" refer to FP Labs LLC d/b/a MidTerm Stays, the operator of this site.
Please read these Terms before using the site. Using the site means you accept them.
MidTerm Stays helps you find extended-stay accommodation, typically stays of a week or longer, by aggregating listings from hotels, extended-stay providers, and third-party travel platforms. We are not a hotel, a property manager, or, except as described in Section 3, the party you're booking with.
Depending on the listing, one of two things happens when you act on a search result:
(a) We send you to a third party's website. Most listings on MidTerm Stays link out to a partner booking site (for example, a major online travel agency). If you click through, you leave mid-termstays.com, and the booking, payment, and any resulting contract are entirely between you and that third party, under their terms, not ours. We are not involved in that transaction and have no ability to modify, cancel, or refund it.
(b) You submit a stay request through our quote tool. For longer stays or properties not bookable instantly online, we may offer a form where you provide your dates and contact information so it can be reviewed and a quote prepared, typically followed up by email. When you use this tool:
We'll try to make clear, at the point you submit a request, which mode applies. If it's ever unclear from what's on the page, assume mode (a): treat any resulting quote or booking as coming from a third party, not from us, unless your confirmation says otherwise.
MidTerm Stays may, for some properties, offer its own checkout so you can complete a booking without leaving mid-termstays.com. This section applies only to bookings completed that way. If a page doesn't describe this kind of direct checkout, Section 2 applies instead.
Who you're contracting with. When you book through a MidTerm Stays checkout, your reservation contract for the accommodation itself is between you and the hotel or accommodation provider ("Accommodation Provider"). Depending on how that checkout is set up, the payment processing and merchant-of-record responsibility for the transaction may sit with MidTerm Stays, with a booking technology provider we use to power the checkout ("Checkout Provider"), or with the Accommodation Provider directly. Your checkout page and confirmation email will state which party is the merchant of record for your specific booking and how to reach them.
Payment. Where MidTerm Stays or a Checkout Provider is the merchant of record, you authorize that party to charge your selected payment method for the total price shown at checkout, made up of the room rate plus taxes and fees as set by the Accommodation Provider or Checkout Provider. MidTerm Stays does not itself store or process full payment card numbers; where a Checkout Provider is involved, that data is transmitted to and handled under their security practices, not ours.
Cancellations and refunds. Cancellation and refund terms for a direct-checkout booking are set by the Accommodation Provider and/or Checkout Provider, not by MidTerm Stays, and will be disclosed before you complete the booking and again in your confirmation email. MidTerm Stays does not independently grant refunds or exceptions. Contact the party identified in your confirmation email as responsible for your booking; if unclear, email us at support@mid-termstays.com and we'll help point you to the right party.
Pricing. The total price shown at checkout is made up of the room rate, applicable taxes, and a service fee for use of our booking tools, broken out however the checkout displays it at the time. This total is disclosed to you prior to finalizing your booking. Any service fee is non-refundable, including if you later cancel or modify your reservation, unless required otherwise by law. That fee goes toward keeping the site and booking flow running and available to help if something comes up with your reservation. Any portion MidTerm Stays receives is already reflected in the total shown at checkout; you will not be billed any additional or separate amount by MidTerm Stays beyond what's shown there.
For bookings under Section 2, MidTerm Stays does not process payment. The party actually charging you will be the third-party site you were redirected to, or the party that ultimately sends you a quote and confirmation, under their own payment terms. We have no visibility into or control over that charge once it happens outside a MidTerm Stays checkout.
Because we don't sell or process accommodation bookings made under Section 2, we don't set cancellation policies for them and can't issue refunds. If you need to cancel, change, or get a refund, contact the party you actually paid: the third-party site you were redirected to, or the party who sent you a quote and confirmation. Their contact information should be in your confirmation email or on their site. If you genuinely can't figure out who to contact, email us at support@mid-termstays.com and we'll try to point you in the right direction.
You must be 18 or older to use this site. You agree to give accurate contact information if you submit a quote request or make a booking, and not to use the site to submit false, abusive, or automated/bulk requests. You also agree not to scrape the site, interfere with its operation, or attempt to access it in ways not intended by normal use.
Listings, pricing, and availability shown on MidTerm Stays come from third-party sources and are refreshed periodically; we don't guarantee they're accurate or current at the moment you view them. Site design, text, and branding that aren't third-party-supplied listing data belong to MidTerm Stays or our licensors.
MidTerm Stays links to third-party websites for your convenience. We don't review, endorse, or take responsibility for the content, policies, or conduct of any linked site.
MidTerm Stays is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, express or implied, to the fullest extent permitted by law, including as to the accuracy of listings or the availability, quality, or safety of any accommodation.

This section doesn't limit any liability that can't be limited under applicable law.
We're not responsible for delays, errors, or unavailability of the site or any booking process caused by events beyond our reasonable control, including outages, natural events, or actions of third parties we work with.
This section affects how disputes between you and MidTerm Stays get resolved. Read it before you use the site.
12.1 Talk to us first. Email legal@mid-termstays.com with any concern before starting a formal claim. We'll try to work it out within 45 days.
12.2 Arbitration, not court. If that doesn't resolve things, any claim against MidTerm Stays arising from these Terms or your use of the site goes to individual, binding arbitration before JAMS under its Streamlined Arbitration Rules and Procedures, instead of a lawsuit, except that you can still use small claims court for a qualifying claim. The arbitration will be seated in Santa Fe County, New Mexico, unless the parties agree on somewhere else, and may be conducted remotely to the extent JAMS rules permit.
12.3 No class actions. You and MidTerm Stays each agree to bring claims only as individuals, not as part of a class, collective, or representative action.
12.4 Opting out. You can opt out of arbitration by emailing legal@mid-termstays.com within 30 days of first using the site, with your name and a statement that you're opting out.
Our Privacy Policy explains what information we collect (including through the quote tool in Section 2(b) and any direct checkout in Section 3) and how it's shared with third parties we work with. That policy is incorporated into these Terms by reference.
We can suspend or end your access to the site at any time, for any reason, including a violation of these Terms.
New Mexico law governs these Terms, except that the Federal Arbitration Act governs Section 12.
We may revise these Terms at any time; the "Last updated" date above will change when we do. Using the site after a revision means you accept it.
